What happens if I am arrested?

If you are arrested for committing a crime you will be taken into police custody, given a court date and be arraigned. The court may set bail depending on the crime you are charged with. If you cannot post the bond you may be incarcerated pending appearance in court. If bond is posted, you will be released and remain free pending appearance at your arraignment. If I am arrested, can the officer search me?

Can the police use force to arrest me?

A police officer may use as much force as is necessary to arrest you. Unreasonable force is assault. After arrest, a police officer may handcuff you if you attempt to escape or the officer considers it necessary to prevent you from escaping. What is D.U.I. and drunk driving?

D.U.I. is "Driving Under the Influence." A person is guilty of the offense if such person is driving or in actual physical control of a vehicle within the state and the person is under the influence of alcoholic beverages or any chemical or controlled substance set forth under the applicable statutes when affected to the extent that his or her normal faculties are impaired or when the person has a blood alcohol level of 0.08% or higher. Can DMV Impose Ignition Interlock Devices?

Are you presumed guilty of if you have a blood alcohol level of 0.08%?
In any criminal case, it is unconstitutional to hold a presumption of guilt against a defendant.
